One Scholarship Official Contest Rules

Contest Eligibility: The 2012 One Scholarship Competition (“Contest”) is only open to legal residents of the 50 United States & District of Columbia, age 18 or older, who are enrolled & in good standing (good standing being 3.0 or higher GPA based on 4.0 scale) as: 1) a full- or part-time undergraduate or graduate student (part-time student being (6) credits or more per semester) at a 2- or 4-year college and/or university that partners with Higher One, Inc. for refund management services or other services at time of entry & prize fulfillment; or 2) a full- or part-time senior at a public or state-accredited private high school, trade school, or vocational school, accepted into a 2- or 4-year college and/or university that partners with Higher One, Inc. for refund management services or other services at time of entry & prize fulfillment. Employees, officers, directors & agents & their immediate family members (mother, father, sister, brother, daughter, son & their respective spouses, regardless of where they reside) & those living in the same household of each of Higher One, Inc. (“Sponsor”), Project Support Team, Inc. (“P/S/T”), & each of their respective parent companies, affiliates, distributors, suppliers, subsidiaries, & advertising & promotion agencies (collectively, “Released Parties”) are not eligible to participate or win. Contest subject to all applicable federal, state & local laws & regulations. Void where prohibited. How to Participate: Between 12:00:01PM Eastern Time (“ET”) on 3/15/12 & 11:59:59PM ET on 4/30/12 (“Promotion Period”), 1) Create a video demonstrating your response to the following Contest topic (“topic”) per the instructions provided: At Higher One, our philosophy is “There is a way”. This means that no matter what the challenges are or how dreary the outlook seems, we believe there is a way to succeed. What does this philosophy mean to you? How have you demonstrated that you have overcome obstacles in the past? Please tell us about your future goal(s), & what steps you are taking to achieve them; 2) Upload your video to your YouTube or Vimeo account; & 3) Visit higherone.com/scholarship, & follow directions to complete the Contest Registration Form & provide a link to your video by entering your video YouTube or Vimeo URL. You must have a YouTube or Vimeo account in order enter. If you are not an existing user of YouTube or Vimeo, you will be required to create a free user account at www.youtube.com or a free basic user account at www.vimeo.com. When you register for either account, you will be required to agree to the applicable site Terms of Use & Privacy Policy. Video must be no longer than (2) minutes long, cannot contain any 3rd parties, footage, music or other material subject to 3rd party rights, & must be entrant’s original video content. Video file size cannot exceed applicable YouTube or Vimeo upload requirements & must comply with YouTube video requirements outlined at http://www.youtube.com/t/howto_makevideo or Vimeo video requirements outline at http://vimeo.com/guidelines#uploading_guidelines. By submitting a video on YouTube, entrants agree to comply with YouTube’s Terms of Service (www.youtube.com/t/terms) & Community Guidelines (www.youtube.com/t/community_guidelines). Failure to comply with such terms & guidelines may result in disqualification. See Judging section below to make sure that your video submission (“Entry”) complies with the video requirements set forth herein, & includes all elements on which Entries will be judged. Entry must be entrant’s original, personal creation, in English & cannot have been previously published, submitted for publication, screened, or publicly viewed, except submissions that were previously submitted but not selected as a winning entry in a prior One Scholarship Competition contest which may be resubmitted for consideration in this Contest. Modification of an existing work does not qualify as original. Limit (1) Entry per person, regardless of the number of email addresses used, for the duration of the Promotion Period. In the case of multiple Entries from any person or email address, only the first Entry received will be accepted & all subsequent Entries received from such person will be void. Entry cannot defame or invade publicity and/or intellectual property rights or the privacy of any person, living or deceased, or otherwise infringe upon any copyrighted works or person’s personal or other proprietary rights, including, without limitation, music, trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others. Entries generated by script, macro or other automated means or deemed by the judges to be immoral, obscene, profane or not in keeping with Sponsor’s image or in violation of these Official Rules will be void. In the event of non-compliance with any requirements specified herein, Entry will be void. Your submission of an Entry constitutes your representation of eligibility, consent to participate in Contest & to adhere to these Official Rules & consent for Sponsor to obtain, use, & transfer your name, address, enrollment & academic standing information & other information for the purpose of Contest administration. Released Parties are not responsible for lost, incomplete, late, stolen, inaccurate, delayed, garbled or misdirected registrations, Entries, videos, or submissions; theft, destruction or unauthorized access to, or alteration of, Entries or videos; failures or malfunctions of phones, phone lines or telephone systems; interrupted or unavailable network, server or other connections, YouTube or Vimeo upload errors, or otherwise; any error, omission, interruption, defect or delay in any transmission or communication; human-processing error; traffic congestion on the Internet or any technical problem, including but not limited to any injury or damage to entrant’s or any other person’s computer related to or resulting from Contest participation; errors or omissions in these Official Rules, in any Contest-related advertisements or other materials, in the selection or announcement of winners or in awarding of prizes; or other problems or errors of any kind whether mechanical, human, electronic or otherwise. Sponsor reserves the right to void any & all Entries of an entrant who Sponsor believes has attempted to tamper with, influence, or impair the administration, security, fairness, judging or proper play of Contest. Neither Sponsor, nor anyone acting on its behalf, will enter into communications with any entrant regarding Contest entry standing other than to notify potential winners. Judging: Eligible Entries received will be judged by a panel of judges (“judges”) designated by Sponsor, whose determinations will be final & binding in all matters relating to Contest. Judging will be based on the following criteria: 1) Impact, including the degree to which the video response achieved the intent of the Contest topic: 33.3%; 2) Creativity/Originality: 33.3%; & 3) Quality, including content & technical: 33.3%. Subject to verification of eligibility & compliance with the terms of these Official Rules, the (20) entrants with the highest total Judging score based on above judging criteria will be declared the potential Grand Prize winners. In the event of a tie, entrant(s) from among those tied with the highest score in Impact will be declared the applicable winner(s). If a tie still exists, from among remaining pool of tied entrants, entrant(s) with highest score in Creativity/Originality, & then in Quality (if & as necessary to break tie), will be declared the applicable winner (collectively “tiebreaker”). Potential winners will be notified by email, phone, and/or overnight delivery service on or about 5/21/12. Sponsor reserves the right to not award all prizes if, in its sole discretion, it does not receive a sufficient number of eligible & qualified Entries. (20) Grand Prizes: $2,500 scholarship awarded on winner’s behalf to College or University where winner will be enrolled for the fall 2012 semester. Scholarship will be awarded in the form of a check to applicable College or University (Approximate Retail Value=$2,500). Total ARV of all prizes=$50,000. Limit (1) prize per person, immediate family, or household. Federal, state & local taxes (if applicable) & all other costs & expenses associated with prize acceptance & use not specified herein are winners' sole responsibility. Miscellaneous: No transfer, assignment, cash redemption, or substitution of scholarship prizes except by Sponsor, who reserves the right to award a prize of comparable or greater value, at its sole discretion. Potential winners will each be required to return the following materials within (5) days of date of issuance of notification: 1) An executed, notarized Affidavit of Eligibility, Liability Release & (where legal) Publicity Release; & 2) A current college or university transcript (showing that he/she is enrolled & in good academic standing as defined by his/her respective college/university at time of winner notification). If a potential winner is a high school senior, said entrant may submit high school transcript showing he/is in good academic standing along with college/university acceptance letter for fall 2012 semester in lieu of current college or university transcript. Non-compliance with any of the foregoing or with these Official Rules may result in disqualification & awarding of prize to a runner-up, at Sponsor’s discretion. If any prize notification email and/or letter is returned as undeliverable, any potential winner cannot be contacted within a reasonable time period, does not reply to correspondence within (5) days following date of attempted notification, or fails to comply with verification process and/or eligibility requirements, that potential winner may be disqualified &, at Sponsor’s discretion, a runner-up winner may be notified. If any potential winner is at least 18 but still considered a minor in his/her jurisdiction of residence, Sponsor reserves the right to award the prize to his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on winners set forth herein. By participating, each entrant & winner agrees to be bound by these Official Rules & the decisions of the Sponsor & judges, which are final & binding, & 1) Attest that Entry is his/her original, personal creation & that it meets all eligibility requirements set forth herein; & 2) Understand that their Entry may be selected for potential use in future Higher One, Inc. advertising and/or promotional materials & further understand that the use of their Entry in potential advertising and/or promotion efforts does not convey any status of any kind with respect to the Contest such as, but not limited to, selection as a winning submission in the Contest or being a Contest winner; & 3) Agree that entrants will retain ownership of his/her Entry however, by entering the Contest, & to the extent allowed by law, entrants grant Released Parties & their designees a non-exclusive, perpetual, sublicensable, royalty-free license to use Entry & that Released Parties & their designees shall have: a) The perpetual, worldwide right to edit, publish, exploit & use Entry (or any portion thereof) in any way & in any media for advertising and/or trade purposes and/or for any other purpose in any media or format, online or offline, now or hereafter known without further compensation, permission or notification from/to entrant or any 3rd party; b) The right & permission (unless prohibited by law) to use entrant’s name, voice, city/state of residence, photograph and/or other likeness for advertising, trade and/or for any other purpose in any media or format now or hereafter known without further compensation, permission or notification & that use of any of the foregoing materials shall not violate the rights of any 3rd parties & shall not violate any applicable federal, state or local laws or ordinances; c) The right to disqualify any entries that they deem to be obscene or otherwise not in good taste; & d) No liability & entrant will defend, indemnify & hold harmless Released Parties, YouTube & Vimeo from & against any liability, loss, injury or damage of any kind (including attorney’s fees) to any person or entity including, without limitation, personal injury, death or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize, participation in this Contest, or use of any entry-related materials. Sponsor reserves the right, in its sole discretion, to modify, suspend, and/or terminate this Contest should virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor corrupt or impair the administration, security, fairness or proper play of the Contest &, in the case of suspension or termination, at its discretion, select winners using the judging criteria provided above from eligible non-suspect entries received prior to event requiring such termination or suspension.
