Game Time Terms and Conditions

The Game Time blog (this “blog”) is a medium for people in the Higher One community to address topics on Higher One’s services.  It is not intended to provide the first announcement of material information or developments about Higher One.  Instead, it is a forum to discuss matters that may have been previously announced through other communication channels or that are not themselves considered material information under any securities laws, even though the matters may be important to you.

Although we welcome feedback from customers, this blog is not intended to replace our network of customer service offerings.  Comments or queries relating to specific issues beyond the scope of this blog should be directed to your respective service provider.  Please go to https://www.higheroneaccount.com/easyhelp for additional assistance or call the phone number listed on the back of your card.

This blog is provided by Higher One, Inc. (Higher One, we or us) and may be used only in accordance with these Terms and Conditions.  By using this blog, you agree to abide by these Terms and Conditions.

Comments Policy

This blog is a forum for you to discuss Higher One and its products and services with other OneAccount cardholders.  All comments will be reviewed before posting and we reserve the right (for any reason) to (i) decide what to post, (ii) reject your posting, (iii) remove your posting at any time, and/or (iv) republish your posting (in edited or unedited format) at any time, without notice, and in any medium without any obligation to compensate you for the posting.

All of your comments must relate to the posted topic and we will post only those comments that we believe are related to and appropriate for OneAccount cardholders.  We will not post or comment on unrelated matters or third party solicitations.  Additionally, comments pertaining to any ongoing financial or legal matters will not be posted.

Our goal is to maintain a blog that is respectful of our cardholders, members of the public, our competitors, and us.  With this in mind, we will not permit comments that in our sole judgment are disrespectful in any manner, including comments that:

• are obscene, promote racism, prejudice, bigotry, hatred or physical harm of any kind against any group or individual;
• harass or advocate harassment of another person or organization;
• contain nudity, violence or offensive subject matter;
• promote information that we believe is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
• allege violations of law, inappropriate behavior or any other misconduct;
• exploit people in a sexual, violent or other manner not respectful of human rights;
• further or promote any criminal activity or enterprise or provide instructional information about illegal activities, such as making or buying illegal weapons or violating someone's privacy;
• solicit passwords or personal information from others for commercial or unlawful purposes;
• knowingly introduce viruses, worms or similar harmful code on the Internet; or
• involve commercial activities and/or sales without our prior written consent, such as contests, sweepstakes, solicitation of donations, bartering, advertising or pyramid schemes except to the extent such comment relates to a Higher One commercial activity.

By posting, uploading, inputting, providing or submitting any information to this blog, you consent to Higher One’s collection of such information, and you grant Higher One and its affiliates, sublicensees and agents permission to use such submitted information in connection with the operation of this blog and its business, including, without limitation, the worldwide, royalty-free rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your submitted information; and to publish your name any contact information you approve of in connection with your submitted information.  You warrant and represent that you own or otherwise control all of the rights to any information submitted by you to Higher One through this blog or otherwise, including, without limitation, all the rights necessary for you to provide, post, upload, input or submit your submitted information, including, without limitation, trademarks and copyrighted material so please do not post any content that is the property of another individual or company.  As stated above, no compensation will be paid with respect to the use of your submitted comments, ideas, suggestions, products or services and Higher One is under no obligation to post or use any such information you may provide and Higher One may remove any such information at any time in its sole discretion.  For greater certainty, Higher One does not claim ownership to any information that you may provide to Higher One, unless otherwise expressly provided.  Notwithstanding the foregoing, any enhancements made by you or anyone acting on your behalf, including your employees, will be the property of Higher One without any further consideration to you, whether or not such enhancements are incorporated into Higher One products and services.

Higher One welcomes comments regarding its products and services.  However, Higher One’s policy is not to accept or consider creative ideas, suggestions or materials other than those it has specifically requested.   We hope you will understand that the intent of this policy is to avoid misunderstandings when projects developed by Higher One’s very productive staff are similar to someone else's creative work.  Accordingly, we must ask that you not send us any such ideas. Although we do value your feedback on our services and products, we request that you be specific in your comments on those services and products and not submit any creative ideas, suggestions or materials.

If, despite our request that you not do so, you send us creative suggestions, ideas, notes, drawings, concepts or other information (collectively, the "Unsolicited Information"), the Unsolicited Information shall be deemed, and shall remain, the property of Higher One.  None of the Unsolicited Information shall be subject to any obligation of confidentiality on the part of Higher One and Higher One shall not be liable or owe any compensation for any use or disclosure of the Unsolicited Information.

We require that you provide your first name, last name and email address as well as the name of the school that you attend(ed) when posting a comment.  We request this information both to deter automated submission of a posting and because we may include that information in postings on this blog.  Because this blog is a public forum, please do not post or supply any personal information that you wish to keep private.  If you submit a posting and include the name of another person we may delete it to protect the privacy of that person.  By registering for this blog, you grant Higher One and/or its affiliates the permission to send e-mails and other electronic communications to you to which you will have the ability to “opt-out” of receiving in the future.

It may take a couple of days for your posting to appear, especially on the weekends, or it may not be published at all.  We may choose not to respond to your comments, or we may respond to some comments or questions either individually or as a cluster of comments or questions about the same topic.  Based on these policies and terms and conditions, we may decide not to publish your posting, and we may cite only some of your posting in our comments or responses.

Governing Law and Venue

THIS AGREEMENT SHALL BE GOVERNED IN ACCORDANCE WITH THE LAWS OF THE STATE OF CONNECTICUT AND ITS VALIDITY, CONSTRUCTION AND EFFECT SHALL BE GOVERNED BY AND ENFORCED PURSUANT TO THE SUBSTANTIVE LAWS OF THE STATE OF CONNECTICUT.  THE PARTIES AGREE THAT ALL LEGAL PROCEEDINGS IN CONNECTION WITH THE ENFORCEMENT, CONSTRUCTION, INTERPRETATION, BREACH OR VIOLATION OF THIS AGREEMENT SHALL BE SUBMITTED TO THE STATE OR FEDERAL COURTS IN NEW HAVEN, NEW HAVEN COUNTY, CONNECTICUT AND THAT JURISDICTION AND VENUE ARE PROPER IN SUCH COURTS.
