Game Time Terms and Conditions

The Game Time blog (this “blog”) is a medium for people in the Higher One community to address topics on Higher One’s services.  It is not intended to provide the first announcement of material information or developments about Higher One.  Instead, it is a forum to discuss matters that may have been previously announced through other communication channels or that are not themselves considered material information under any securities laws, even though the matters may be important to you.

Comments Policy

This blog is a forum for you to discuss Higher One and its products and services with other OneAccount cardholders.  All comments will be reviewed before posting and we reserve the right (for any reason) to (i) decide what to post, (ii) reject your posting, (iii) remove your posting at any time, and/or (iv) republish your posting (in edited or unedited format) at any time, without notice, and in any medium without any obligation to compensate you for the posting.

All of your comments must relate to the posted topic and we will post only those comments that we believe are related to and appropriate for OneAccount cardholders.  We will not post or comment on unrelated matters or third party solicitations.  Additionally, comments pertaining to any ongoing financial or legal matters will not be posted.

Our goal is to maintain a blog that is respectful of our cardholders, members of the public, our competitors, and us.  With this in mind, we will not permit comments that in our sole judgment are disrespectful in any manner, including comments that:

Higher One welcomes comments regarding its products and services.  However, Higher One’s policy is not to accept or consider creative ideas, suggestions or materials other than those it has specifically requested.   We hope you will understand that the intent of this policy is to avoid misunderstandings when projects developed by Higher One’s very productive staff are similar to someone else's creative work.  Accordingly, we must ask that you not send us any such ideas. Although we do value your feedback on our services and products, we request that you be specific in your comments on those services and products and not submit any creative ideas, suggestions or materials.

If, despite our request that you not do so, you send us creative suggestions, ideas, notes, drawings, concepts or other information (collectively, the "Unsolicited Information"), the Unsolicited Information shall be deemed, and shall remain, the property of Higher One.  None of the Unsolicited Information shall be subject to any obligation of confidentiality on the part of Higher One and Higher One shall not be liable or owe any compensation for any use or disclosure of the Unsolicited Information.

We require that you provide your first name, last name and email address as well as the name of the school that you attend(ed) when posting a comment.  We request this information both to deter automated submission of a posting and because we may include that information in postings on this blog.  Because this blog is a public forum, please do not post or supply any personal information that you wish to keep private.  If you submit a posting and include the name of another person we may delete it to protect the privacy of that person.  By registering for this blog, you grant Higher One and/or its affiliates the permission to send e-mails and other electronic communications to you to which you will have the ability to “opt-out” of receiving in the future.

Governing Law and Venue

THIS AGREEMENT SHALL BE GOVERNED IN ACCORDANCE WITH THE LAWS OF THE STATE OF CONNECTICUT AND ITS VALIDITY, CONSTRUCTION AND EFFECT SHALL BE GOVERNED BY AND ENFORCED PURSUANT TO THE SUBSTANTIVE LAWS OF THE STATE OF CONNECTICUT.  THE PARTIES AGREE THAT ALL LEGAL PROCEEDINGS IN CONNECTION WITH THE ENFORCEMENT, CONSTRUCTION, INTERPRETATION, BREACH OR VIOLATION OF THIS AGREEMENT SHALL BE SUBMITTED TO THE STATE OR FEDERAL COURTS IN NEW HAVEN, NEW HAVEN COUNTY, CONNECTICUT AND THAT JURISDICTION AND VENUE ARE PROPER IN SUCH COURTS.
